These Terms of Service (the "Terms") govern your access to and use of realistgpt (the "Service"), operated by realistgpt ("we", "us", "our"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is

realistgpt is an AI-assisted conversational tool that aims to give blunt, reasoned responses to user prompts. The Service is provided "as is" and is not a substitute for professional medical, legal, psychological, financial, or other licensed advice. Always consult a qualified professional for decisions in those areas.

2. Eligibility & accounts

• You must be at least 13 years old (16 in the EEA/UK) to use the Service. Users under 18 must have permission from a parent or legal guardian.
• One account per person. Do not share credentials. You are responsible for activity under your account.
• You must provide accurate information when creating an account and keep it current.

3. Subscriptions, billing, auto-renewal

• Paid plans (Real, Built) are billed in advance on a recurring basis at the rate shown at checkout (monthly or annual).
• Subscriptions automatically renew at the end of each billing cycle until cancelled.
• Cancel at any time from your billing portal. Access continues through the end of the period already paid for; you will not be billed again.
• We may change prices for future billing periods with reasonable advance notice (typically 30 days).
• Taxes, where applicable, may be added at checkout.

4. Refunds

Refunds are governed by our Refund Policy. In summary: monthly subscriptions are refundable within 14 days of the initial charge; annual subscriptions are refundable within 30 days of the initial charge. Outside those windows, payments are non-refundable.

5. Acceptable use

You agree not to use the Service to:

• Generate or distribute content that is illegal, sexually exploitative of minors, harassing, defamatory, or that promotes violence against a person or group.
• Attempt to bypass our content moderation, rate limits, or security controls.
• Reverse engineer the Service or its prompts, or use scraping/automation to extract bulk content or system behavior.
• Use the Service to provide professional medical, legal, financial, or psychological advice to third parties.
• Resell, redistribute, or sublicense access to the Service.

We may suspend or terminate accounts that violate these rules, without notice in egregious cases.

6. Content

• Your inputs. You retain ownership of the prompts and inputs you submit. You grant us a worldwide, non-exclusive license to process them solely to operate, improve, and secure the Service.
• AI outputs. Outputs are generated by AI models and may be inaccurate, incomplete, biased, or offensive. Verify before relying on them. You are responsible for how you use outputs.
• Our IP. The Service, including its branding, design, and software, is owned by us and protected by intellectual property laws.

7. Privacy

Our processing of your personal data is described in the Privacy Policy, which is incorporated into these Terms.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of liability

To the maximum extent permitted by law, in no event shall we, our affiliates, or our suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. Our aggregate liability for any claim related to the Service is limited to the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold us harmless from any claim, loss, or damage arising from your use of the Service in violation of these Terms or applicable law.

11. Termination

You may close your account at any time. We may suspend or terminate your access if you violate these Terms or for legal reasons. Sections that by their nature should survive termination (including IP, disclaimers, liability, and governing law) will survive.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice with a reasonable lead time. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which the operator of realistgpt is established, without regard to its conflict-of-laws principles. Disputes shall be resolved in the courts of that jurisdiction, except where mandatory consumer-protection law provides otherwise.
